Terms of Service and Office Policies

Nadir Qazi (“Nadir Qazi” or “we”) operates the website nadirqazi.com and provides the services described herein. These Terms of Service and Office Policies (“Terms”) govern your access to and use of our Site and services.

1. Acceptance of Terms

These Terms govern your use of the Site, your purchase of services, your participation in our Loyalty Program, and any submission of information through forms, quizzes, contact inquiries, or promotional sign-ups on our Site. By accessing this Site, submitting any form, booking an appointment, making a purchase, or receiving any service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, discontinue use of the Site and our services immediately.

You acknowledge that you have not relied on any representations, warranties, or promises not expressly set forth in these Terms or in a separate signed Medical Informed Consent.

SCOPE OF THESE TERMS: These Terms apply to all in-person services and preparatory virtual/telehealth consultations provided by Nadir Qazi, a sole proprietor for the New York pop-up locations. General telehealth treatments or virtual consultations conducted through Qazi Cosmetic Center’s California facility are expressly excluded from these Terms and are governed by Qazi Cosmetic Center’s separate Terms of Service and Office Policies.

You confirm that you are at least 18 years of age and legally capable of entering into a binding contract. If you purchase or schedule services on behalf of another person, you represent and warrant that you have the legal authority to bind them to these Terms.

1.1 Patient Representations

You represent that all information you provide to Nadir Qazi, including medical history, medications, allergies, and health conditions, is accurate and complete. You agree to update Nadir Qazi promptly of any changes prior to each appointment.

You assume all risks associated with your failure to disclose accurate, complete, or updated medical information, and you release Nadir Qazi from any liability arising from such nondisclosure to the fullest extent permitted by law.

1.2 Minors

For patients under 18 years of age, the parent or legal guardian who books and pays for services agrees to be bound by these Terms and must provide written consent before any service is performed. The parent or guardian is financially responsible for all charges incurred.

2.1 No Medical Advice

All content on this Site is for general educational and informational purposes only. It does not constitute medical advice, diagnosis, or treatment. No doctor-patient relationship is created by your use of this Site, viewing of our content, or submission of an inquiry.

2.2 No Doctor-Patient Relationship Created by Site Use

Your use of this Site does not create a doctor-patient relationship between you and Nadir Qazi or any of his providers. No doctor-patient relationship is formed unless and until you complete an in-person or preparatory virtual consultation and sign a separate Medical Informed Consent specific to your treatment. Communications through this Site are not confidential or privileged in the same manner as medical communications.

2.3 Required Evaluation

All patients must complete an evaluation and sign a separate Medical Informed Consent before receiving treatment. These Terms are financial and office policies; they are separate from your clinical documentation.

2.4 No Outcome Guarantees

Individual results vary based on anatomy, skin type, compliance with aftercare, and other factors. Nadir Qazi makes no guarantees of specific outcomes. Before-and-after photographs on our Site represent individual experiences and do not constitute a promise of similar results.

2.5 Treatment Eligibility

All treatments require provider evaluation and approval as set forth in Section 4.13. Purchasing a treatment or package does not guarantee medical eligibility.

3. Definitions

3.1 Defined Terms

  • “Category 1” means Non-Surgical Aesthetic Treatments as described in Section 5.1.
  • “Category 2” means Surgical & Advanced Reconstructive Procedures as described in Section 5.2.
  • “Category 3” means Retail Products, Merchandise & Shipping as described in Section 5.3.
  • “Category 4” means Ancillary Services & Third-Party Fees as described in Section 5.4.
  • “Promotional Credits” means credits issued under our loyalty program that have no cash value and may only be redeemed for eligible services.
  • “Rewards Points” means points earned under our Rewards Program as described in Section 8.1.
  • “Deposit” means any advance payment required to secure an appointment or service.
  • “Invoice” means the total quoted or actual charges for services, products, or ancillary items.
  • “Business Day” means Monday through Friday, excluding federal holidays observed in California.
  • “Written Notice” means communication submitted via email to contact@nadirqazi.com. Verbal cancellations, voicemail cancellations, or messages sent to unapproved digital or social channels are not legally valid.
  • “Proposal Acceptance Date” means the date a treatment proposal is accepted, whether via signed written document or verbal confirmation over the phone.

3.2 Liquidated Damages Standard

Where these Terms provide for liquidated damages, those amounts represent a genuine and reasonable pre-estimate of our actual anticipated losses, including reserved provider time, treatment room or facility occupancy, staff allocation, supplies prepared specifically for your appointment, equipment allocation, and the lost opportunity to treat another patient in your reserved slot. They are not a penalty.

4. Universal Booking & Payment Policies

The following policies apply to all patients and all service categories unless expressly modified in a specific Service Category section below.

4.1 Appointment Confirmation

You may reserve your appointment by accepting your treatment proposal and submitting full payment of the entire proposal amount. Equipment, supplies, resources, and clinical time are allocated and coordinated immediately upon acceptance. No appointment is reserved until full payment has been received and acknowledged in writing by Nadir Qazi. Verbal confirmations are not valid.

4.2 Cancellation & Refund Timeline

A “cancellation” includes any request to terminate, postpone, reschedule, or modify an appointment. Rescheduling or modification is treated as a cancellation of the existing appointment unless expressly authorized in writing by Nadir Qazi. Cancellations may be made strictly by phone call (speaking directly with clinic personnel) or email to contact@nadirqazi.com.

Refunds for cancellations are determined strictly by the timing of your cancellation relative to your scheduled treatment date:

  • More than 14 days before your treatment date: 100% refund to your original payment method.
  • 14 days to 8 days before your treatment date: 100% refund to your original payment method.
  • 7 days to 73 hours before your treatment date: 50% refund to your original payment method; 50% retained as liquidated damages under Section 3.2.
  • 72 hours or less before your treatment date: Full retention of your payment as liquidated damages under Section 3.2; no refund.

4.3 Medical Fitness

If your health status changes after you book—including pregnancy, new medications, or acute illnesses—you must inform us immediately. Because we reserve dedicated resources for you, our cancellation timeline still applies even when the change is medical. We will assist you in rescheduling for the earliest safe date under the modification policies in Section 4.6.

4.4 Late Arrival & No-Show Definition

Arriving more than fifteen (15) minutes late may result in rescheduling or cancellation of your appointment, subject to the same liquidated damages as a late cancellation. A "no-show" will result in total forfeiture of payment as liquidated damages and is defined explicitly as:

  • Failure to arrive at the treatment facility by the scheduled appointment time;
  • Failure to physically check in with our front staff at the scheduled time;
  • Arrival more than fifteen (15) minutes late where the attending provider determines the treatment cannot be safely or properly completed in the remaining block of time; or
  • Failure to complete required pre-appointment virtual visits or electronic medical paperwork submissions by the stated deadline.

4.5 One-Year Completion and Administrative Case Closure

All prepaid services must be completed within one (1) year from the Proposal Acceptance Date. This policy reflects the clinical necessity of timely treatment completion for patient safety and optimal outcomes. If services are not completed within this one-year period, the prepaid agreement terminates, and any remaining prepaid balance is retained as a final administrative case management fee to cover chart maintenance, record retention, compliance documentation, and operational capacity costs. Unused balances are non-refundable and non-transferable after this period.

Our actual operational costs in holding reserved clinical capacity and maintaining dormant files match or exceed the retained balance. This fee is not a penalty, but reasonable compensation for administrative expense.

4.6 Modification & Rescheduling Fees

You may add services to your treatment plan only if Nadir Qazi determines you are a candidate and if there is availability of supplies, equipment, and resources. Additional treatments beyond your original proposal cannot be guaranteed. If you remove services after acceptance, you remain responsible for your full original invoice total. The liquidated damages standard in Section 4.2 applies to any modification that results in a partial cancellation.

If you reschedule your appointment with more than 14 days’ notice, your original quoted price remains valid. If you reschedule within 14 days of your appointment, your pricing may update to current market rates, and any prior quoted price becomes void. Nadir Qazi is not financially liable for any delays or third-party surgical facility adjustments.

4.7 Practitioner-Initiated Cancellation

If Nadir Qazi cancels your treatments due to an unforeseen issue, any amounts you have paid for treatments not serviced will be refunded to your original payment method within thirty (30) days. This refund obligation applies only to treatments that were paid for but not performed. Nadir Qazi reserves the right to reschedule cancelled treatments to the earliest available date rather than issue a refund, at Nadir Qazi’s sole discretion and with your written consent.

4.8 Quote Validity

All proposals and quotes are valid for thirty (30) calendar days from the date of issuance.

4.9 Payment Methods

We accept cash, major credit cards, cashier’s checks (provided 48 hours in advance), wire transfers, Zelle, and Cherry financing. We do not participate in or bill insurance plans. You are personally and financially responsible for all charges regardless of any anticipated insurance reimbursement or third-party payment.

Financing Provider Notice: Any refunds for services or packages purchased via third-party financing providers (such as Cherry financing) are strictly subject to the terms and conditions of that respective financing provider. Approved refunds may be net of any applicable merchant processing fees or transaction costs incurred by Nadir Qazi. Cherry financing for Nadir Qazi services is extended under Nadir Qazi’s merchant account and is subject to Nadir Qazi’s separate financing terms.

4.10 Refunds

Eligible refunds are issued to the original payment method within thirty (30) days. Cash refunds are issued by check within thirty (30) days. All rendered services, completed appointments, opened or used products, and items with removed seals are final sale.

4.11 Collections and Administrative Cost Recovery

Accounts past due by forty-five (45) days may be referred to a third-party collection agency or legal counsel. You explicitly authorize Nadir Qazi to add all reasonable administrative costs, collection agency fees, court costs, and actual legal fees to any past-due balance referred for collection. Past-due balances shall accrue interest at a rate of one and one-half percent (1.5%) per month (eighteen percent (18%) per annum), or the maximum lawful rate permitted under New York usury laws for non-corporate debtors, whichever is lower, from the date the balance becomes past due until paid in full.

4.11.1 Payment Disputes and Wrongful Chargebacks

You agree not to initiate a credit card chargeback, merchant payment dispute, or reversal of any valid charge without first contacting Nadir Qazi in writing and allowing ten (10) Business Days to resolve the matter. You agree to reimburse Nadir Qazi for all actual chargeback fees, bank financial penalties, and documented administrative staff costs incurred due to wrongful, malicious, or frivolous disputes. In the event of an un-resolved chargeback, Nadir Qazi reserves the right to immediately suspend clinical services, terminate Loyalty Program privileges, and refer the account to collections.

4.12 Non-Transferability

Prepaid services, payments, and credits are non-transferable to another person and cannot be transferred between service categories unless authorized in writing.

4.13 Provider Discretion

All services are provided at the sole discretion of the attending provider. You will be evaluated immediately prior to treatment. If your provider determines that a treatment is not appropriate, safe, or beneficial, the service will be deferred or declined. In such cases, your payment may be applied to an alternative service at the provider’s discretion, subject to Section 4.6.

4.14 Right to Decline or Discontinue Services

Nadir Qazi reserves the right to decline to provide services to any prospective patient, or to discontinue services to any existing patient, at any time and for any lawful reason in his sole professional discretion, including but not limited to safety concerns, policy violations, staff or provider discomfort, inappropriate behavior, or operational capacity limits. We will comply with all applicable laws regarding continuity of care and emergency treatment when discharging a patient from care. If we terminate the relationship due to a violation of Section 15 (Patient Conduct), all deposits and prepayments shall be forfeited as liquidated damages.

4.15 Pre-Procedure Vitals and Emergency Protocol

Your vitals, including blood pressure, may be checked at any point during your visit to confirm that you are medically prepared and safe to proceed. If your vitals indicate that you are not medically fit to proceed, we may delay or cancel your treatment. You are responsible for all costs associated with outside medical services or emergency transport. Nadir Qazi does not assume responsibility for travel or accommodation costs arising from a medical cancellation.

By providing your email address to Nadir Qazi through any form, quiz, inquiry, or promotional sign-up on our Site, you consent to receive email communications from us. These communications fall into two categories:

  • Operational emails are necessary for your care and may include appointment confirmations, pre-visit instructions, post-treatment follow-up, and billing notices. You may not opt out of operational emails while you have an active appointment or outstanding balance, as these communications are part of our standard care protocol.
  • Marketing emails include information about promotions, new services, events, and educational content. You may opt out of marketing emails at any time by clicking the unsubscribe link at the bottom of any marketing email or by emailing contact@nadirqazi.com. We will process your opt-out request within ten (10) Business Days. Opting out of marketing emails does not remove you from operational email communications.

5. Service Categories

5.1 Category 1: Non-Surgical Aesthetic Treatments

5.1.1 Scope

Category 1 includes all non-surgical injectables, fillers, laser acne treatments, laser hair removal, hair restorations, and skin resurfacing therapies.

5.1.2 Deposit & Payment

Payment must be completed in full upon proposal acceptance in accordance with the universal booking requirements set forth in Section 4.1.

5.1.3 Cancellation

Cancellations, rescheduling requests, and associated refunds or liquidated damages are strictly governed by the universal timeline and terms set forth in Section 4.2.

5.1.4 Prepaid Packages (Laser, Tattoo Removal, Peel & Pico)

Cancellations or modifications for prepaid package sessions are governed entirely by the universal cancellation and refund policy set forth in Section 4.2. If you request a refund for an unused portion of a discounted package, completed sessions will be recalculated and charged at the full current non-discounted price per session before any remaining balance is returned. All package services must be completed within one (1) year from the Proposal Acceptance Date.

5.2 Category 2: Surgical & Advanced Reconstructive Procedures

5.2.1 Scope

Category 2 includes surgical and advanced reconstructive procedures such as liposuction, lifts, blepharoplasty, excisions, and deep resurfacing applications.

5.2.2 Deposit & Full Payment Deadline

Payment must be completed in full upon proposal acceptance in accordance with the universal booking requirements set forth in Section 4.1.

5.2.3 Cancellation & Refunds

Cancellations, rescheduling requests, and associated refunds or liquidated damages for Category 2 procedures are strictly governed by the universal timeline and terms set forth in Section 4.2.

5.3 Category 3: Retail Products, Merchandise & Shipping

5.3.1 Scope & Payment

Category 3 includes skincare products, merchandise, and shipping fees. Items must be paid in full at the time of purchase. Rewards Points may not be earned or redeemed for Category 3 items.

5.3.2 Returns

All product returns and exchanges are governed by Section 11 (Shipping & Returns). Unopened, non-prescription items may be returned within seven (7) days of delivery. Prescription skincare products, compounded medications, and medical devices are final sale and cannot be returned.

5.4 Category 4: Ancillary Services & Third-Party Fees

5.4.1 Scope & Strict Terms

Category 4 includes Anesthesia Fees, Biopsy/Pathology, Facility Fees, Labs, Imaging, and EKGs. These are immediate pass-through costs that Nadir Qazi cannot recover from third-party providers. Therefore, Category 4 fees are strictly non-refundable and non-transferable under all circumstances, regardless of the reason for cancellation or medical non-clearance.

5.4.2 Program Exclusions

Rewards Points cannot be earned or redeemed for Category 4 services. All prepaid ancillary balances are subject to the one-year case closure rule from the Proposal Acceptance Date.

5.5 Accure Laser Treatment & Specialty Services

Single and package Accure treatments, as well as Ultrasound-Guided Filler Assessments, require upfront payment or diagnostic payments.

5.6 Outside-Location Treatments and Special Events

For treatments held outside of our standard operational facility, your full proposal amount is due when you reserve your appointment. This allows us to secure your time, coordinate resources, and prepare the specific equipment and supplies required for your visit.

You may cancel within twenty-four (24) hours of booking for a complete refund to your original payment method. If you cancel after that refundable window but more than fourteen (14) days before your appointment, we retain fifty percent (50%) as liquidated damages and refund the remaining fifty percent (50%). If you cancel within fourteen (14) days of your appointment, your full payment is retained as liquidated damages to cover the resources, equipment, supplies, and coordination prepared specifically for your reservation.

Once your proposal is accepted, you may modify your treatment plan only if your new selections can be performed with the limited equipment and supplies available at our outside location. We cannot guarantee treatments beyond your original proposal. If you remove services or products after the twenty-four (24) hour refundable window closes, you remain responsible for your full original invoice total.

5.6.1 Practitioner-Initiated Outside Cancellation

If Nadir Qazi must cancel your outside-location treatments due to an unforeseen issue, and you have not breached these Terms or any office policy including Section 15 (Patient Conduct), we will prioritize your rescheduling or refund you for any cancelled treatments to your original payment method within thirty (30) days. This practitioner-initiated cancellation policy does not apply if your appointment is cancelled due to your breach of these Terms, misconduct, or safety concerns. In such cases, standard liquidated damages policies apply, and no refund obligation arises.

6. Consultations

Consultation fees are professional fees for provider time and clinical evaluation. They are due in full at the time of booking and are assigned exclusively to the registered patient. Cancellations for consultations are governed by the universal cancellation and refund policy set forth in Section 4.2. Once a consultation has been completed, no refunds are available for any reason.

7. Telehealth & Virtual Visits

Patients must submit all requested photos and medical history forms at least forty-eight (48) hours prior to the scheduled virtual visit. Failure to do so will result in the session being cancelled and treated as a late no-show. Patients must join from a private, well-lit room and are strictly prohibited from recording or screenshotting any portion of the secure video conference.

8. Promotional Credits & Rewards Program

8.1 Rewards Points

Patients earn one (1) Rewards Point per $1 spent on eligible services, credited upon service completion. Points redeem at a rate of 20 points = $1 toward eligible services. Points expire twelve (12) months from the completion date of the service under which they were earned. Points have no cash value, are not personal property, and cannot be earned or redeemed on Category 3 items, Category 4 services, or taxes.

Points and rewards balances will be immediately redacted or adjusted following any post-transaction audit or eligible fee refund. Employees and family discounts are excluded from point accumulation. Points are awarded only for services rendered to the individual account holder.

8.2 Referral Rewards

Referral rewards are promotional credits that apply strictly to new Category 1 or Category 2 service invoices exceeding a minimum $500 purchase requirement. They are valid for one (1) year, cannot be used as deposits, are non-transferable, and cannot be applied toward Category 3 items or Category 4 fees.

8.3 Discretionary Program Boundaries & Non-Aggregation

All Rewards Points, Referral Rewards, and promotional credits earned under these Terms are native to this pop-up practice structure and do not automatically transfer to, or combine with, reward balances or profiles at external aesthetic practices, including Qazi Cosmetic Center in California.

However, Nadir Qazi reserves the right, in his sole and absolute discretion, to permit the cross-redemption, transfer, or manual honoring of points with specific designated affiliated practices on a strict case-by-case basis. Any such discretionary accommodation for a specific patient does not constitute a permanent waiver of these Terms, nor does it establish a binding policy change or entitlement for any other patient profile.

9. Loyalty Program

Every patient who completes and pays for an eligible service is automatically enrolled in the free Nadir Qazi Loyalty Program. There are no paid tiers or annual fees. Privileges may be suspended or terminated if no services are received for twenty-four (24) months, or immediately if a patient abuses program privileges (including multiple late cancellations or initiating an improper payment chargeback). All services within this program must be completed within one (1) year from the Proposal Acceptance Date.

Program milestones and status metrics are native to transactions completed under these Terms. Cross-recognition or manual status adjustments across affiliated practices are subject to the same strict sole discretionary approval of Nadir Qazi outlined in Section 8.3.

10. Nadir Qazi Warranty Program

The Nadir Qazi Warranty Program offers eligible patients a 55% discount off the then-current list price for follow-up and maintenance treatments, valid for five (5) years from the enrollment date. To qualify for the Acne Scar, Accure Acne, or Treatment Package Warranty sub-programs, the entire original proposal or qualifying package must be purchased in a single transaction without subsequent modifications or omissions.

All warranty services remain subject to provider evaluation and approval under the standards of Section 4.13. Non-compliance with home care protocols or office policies may result in removal from the program.

This warranty framework applies strictly to qualifying treatments completed under these Terms; any extension of these warranty privileges, follow-up scheduling, or validation at separate physical facilities or affiliated practices remains subject to the sole and absolute discretion of Nadir Qazi under Section 8.3.

11. Shipping & Returns

11.1 Shipping Scope

Products are shipped within the United States unless otherwise stated. Nadir Qazi is not liable for carrier delays, theft, weather events, customs issues, or other delivery disruptions outside his control. The receiver is responsible for all taxes, duties, import fees, customs charges, or other governmental assessments associated with delivery.

11.2 Final Sale

All product sales are final once opened, used, or if seals or tags are removed.

11.3 Return Window

Unopened, non-prescription items may be returned within seven (7) days of delivery. To initiate a return, contact us for authorization. Returns without prior authorization will not be accepted.

11.4 Return Shipping

The patient is responsible for all return shipping costs. Nadir Qazi does not provide prepaid return labels unless the return is due to his verified error.

11.5 Prescription Products

Prescription skincare products, compounded medications, and medical devices may not be returned under any circumstances except as required by law.

12. Intellectual Property & Website Use

12.1 Ownership & Permitted Use

All content and works of authorship contained on this Site—including but not limited to text, images, designs, photographs, videos, sound recordings, logos, graphics, and software—are the exclusive property of Nadir Qazi and are protected by copyright, trademark, and intellectual property laws. Nadir Qazi owns all rights to every piece of media on this website, and redistribution of any copy, content, or media from our Site is strictly prohibited.

Except as permitted under the Copyright Act of 1976 (17 U.S.C. § 107) for downloading and printing hard copies for personal, non-commercial use (provided you do not alter or remove any copyright or proprietary notices), any copying, reproduction, scraping, framing, transmission, redistribution, republication, or display of this content without Nadir Qazi’s prior written consent is strictly prohibited. Third-party redistribution of patient media displayed on this site is explicitly prohibited.

Nadir Qazi is not legally or financially liable for website downtime, transmission errors, or utility failures outside of his control.

12.3 Content Disclaimer, Opinions, and Artificial Intelligence (AI) Output

All views, articles, and media expressed on this Site represent general opinions shared for discussion and educational purposes only. Nadir Qazi may utilize artificial intelligence (AI) tools, automated applications, and machine learning technologies to generate written content, assist with customer inquiries, or power interactive website functionality.

  • AI Can Make Mistakes: You expressly acknowledge that automated tools, chatbots, and AI platforms are imperfect and can generate inaccurate information, technical glitches, or factual errors by accident. It is your sole responsibility to independently verify all information found on this Site before relying on it.
  • Limitation of Liability for Accidental Errors: Nadir Qazi does not warrant or guarantee the absolute accuracy, reliability, or timeliness of any text, automated chat response, or media on this website. 14. Privacy & Data Protection

14.1 General Privacy Parameters

Website contact data is governed by our online Privacy Policy; formal patient medical charting is securely managed under HIPAA regulations and our Notice of Privacy Practices. Personal or contact details provided through online inquiries are kept confidential and are never sold to external data brokers or shared with third parties for independent marketing purposes. To protect your privacy, refrain from submitting private health information (PHI) through the contact form, quizzes, website submissions, or email enrollment.

14.2 Machine Learning and Strict Data Restrictions

We may use de-identified and aggregated operational metrics for internal quality improvement, standard clinical compliance audits, and internal practice outcome tracking. Patient records, personal identification data, and treatment charts are maintained exclusively within secure electronic configurations under our direct operational control. Any processing by third-party vendors is governed by Business Associate Agreements compliant with HIPAA.

Nadir Qazi explicitly guarantees that we do not license, transfer, feed, or sell identifiable or de-identified patient data, intake photography, or treatment media to external artificial intelligence platforms, third-party text-generation databases, commercial machine learning models, or external consumer data brokers.

14.3 Classification and Ownership of Patient Media

Nadir Qazi categorizes patient media into three distinct tiers to protect clinical integrity and manage office operations:

  • Clinical Evaluation Photos: Photographs used for clinical evaluation, diagnosis, or treatment planning are protected as Protected Health Information (PHI) and maintained as part of your legal “Designated Record Set” (DRS) in accordance with HIPAA and applicable medical recordkeeping laws.
  • In-Office Aesthetic Tracking Media: Photos or videos captured in-office during routine visits are used strictly for internal quality control, administrative progression tracking, and provider visual reference. They are not used for medical diagnosis or treatment decisions.
  • Marketing & Promotional Media: With your explicit written permission, certain in-office photographs or treatment videos may be used for website, educational, or social media promotional purposes.

Because In-Office Aesthetic Tracking Media and Marketing Media are purely operational or promotional, they do not constitute a part of your legal medical chart or HIPAA Designated Record Set (DRS). Nadir Qazi is neither legally obligated nor operationally equipped to archive, retrieve, or provide copies of non-DRS media, raw footage, or public marketing assets in response to a medical record request. All such media remains the proprietary administrative property of Nadir Qazi.

By providing your contact information, you consent to receive operational communications (appointment reminders, balances) and opted-in marketing communications via email or telephone calls. You may opt out of marketing emails by clicking “manage subscription.”

14.5 Website Forms and Pre-Patient Data

Information you submit through contact forms, quizzes, promotional sign-ups, or other non-clinical inquiries on our Site is collected and processed under our Privacy Policy. This information is not protected health information unless and until you become a patient and clinical records are created. We may use your contact information to respond to your inquiry, send educational materials, and delivery marketing communications about our services. You may request deletion of your pre-patient contact data at any time by emailing contact@nadirqazi.com.

15. Patient Conduct & Safety

We maintain a zero-tolerance policy to protect our safe, respectful clinic environment. The following activities are strictly prohibited on Nadir Qazi premises and during virtual visits:

  • Carrying weapons of any kind regardless of licensing, concealed permits, or state reciprocity.
  • Sexual harassment, unwanted advances, or intimidation.
  • Abusive, profane, demeaning, or discriminatory communication.
  • Theft, property damage, or unauthorized video/audio recording of staff or other patients.

15.1 Consequences of Misconduct & Recording Prohibitions

To preserve absolute medical privacy and protect staff dignity, the unauthorized audio or video recording of clinical personnel, providers, or other patients within our facility or during secure video conferences is completely prohibited. Personal note-taking is permitted.

Violation of any component of this section results in the immediate and irreversible termination of the patient relationship, cancellation of all remaining service proposals, absolute permanent ban from the practice properties, and total forfeiture of all outstanding prepayments and deposits as liquidated damages. Nadir Qazi explicitly reserves all civil remedies, including referring recording violations or structural damage to local law enforcement. Common areas of our physical facility (excluding treatment rooms, restrooms, and changing areas) utilize continuous video monitoring for safety and quality assurance. Telephone calls to and from our office may be recorded for quality assurance and training purposes; by calling our office, you consent to such recording.

16. Governing Law & Dispute Resolution

16.1 Governing Law & Binding Arbitration

These Terms are governed by the laws of the State of New York. Any non-medical dispute, collection claim, or structural disagreement arising out of your relationship with Nadir Qazi shall be resolved exclusively through binding arbitration in New York County, New York, under the American Arbitration Association (AAA) Consumer Arbitration Rules. By accepting these terms at first use of this Site “www.nadirqazi.com”, you waive the right to a jury trial or to participate in class action proceedings. This provision does not apply to claims involving medical negligence or patient injury, which are litigated separately.

While arbitration and governing law are strictly tied to New York, all formal legal notices must be physically delivered to the California administrative address listed in the Contact section of these Terms to be deemed legally served.

16.2 Arbitration Opt-Out

Within thirty (30) days of first accepting these Terms, you may opt out of the arbitration agreement by sending a clear written notice containing your full legal name and address via mail or email to contact@nadirqazi.com.

17. Amendments & Entire Agreement

Nadir Qazi reserves the right to amend, modify, or update these Terms at any time, effective immediately upon website posting. Continued use of the Site or booking of appointments constitutes formal acceptance of revised terms. These Terms, alongside our Privacy Policy, Notice of Privacy Policy, and separately signed clinical consents, constitute the entire legal agreement between you and Nadir Qazi. The failure of Nadir Qazi to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver shall be effective unless in writing signed by an authorized representative of Nadir Qazi.

17.1 Assignment

Nadir Qazi may assign his rights and obligations under these Terms without your consent. You may not assign your rights or obligations without Nadir Qazi’s prior written consent.

18. Limitation of Liability

To the fullest extent permitted by law, Nadir Qazi’s total liability for any claim arising out of or relating to these Terms, your use of the Site, or any non-medical services shall not exceed the total amount you paid to Nadir Qazi for services in the twelve (12) months preceding the claim.

Under no circumstances shall Nadir Qazi be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages. This includes, without limitation, patient travel costs, lodging expenses, airfare, lost wages, or missed business opportunities arising from rescheduled, delayed, or cancelled treatments.

Any non-medical legal action, arbitration, or claim arising out of or relating to these Terms, the Site, or business operations must be commenced within one (1) year after the cause of action accrues, or be permanently barred, overriding any longer statutory limitations periods under state law.

This limitation does not apply to claims for professional negligence, medical malpractice, bodily injury, death, fraud, willful misconduct, or violations of law that cannot be limited by contract.

19. Indemnification

You agree to indemnify, defend, and hold harmless Nadir Qazi and his employees, agents, contractors, and staff from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms, your negligent or willful misconduct, or your failure to disclose accurate and complete medical history.

20. Force Majeure

Nadir Qazi shall not be liable for any failure or delay in performance due to circumstances beyond his reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, government action or regulation, equipment failure, labor disputes, or interruption of third-party services. Nadir Qazi will use commercially reasonable efforts to resume performance as promptly as practicable under the circumstances.

21. Severability

If any provision of these Terms is held invalid, unenforceable, or void by a court or arbitrator of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent as closely as possible. The remaining provisions will continue in full force and effect.
